Terms and Conditions
ARTICLE 1 - Scope
These General Terms and Conditions of Sale (referred to as "GTC") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("The Clients or the Client") wishing to purchase the products offered for sale ("The Products") by the Seller on the website woocommerce-to-pipedrive.com. The Products offered for sale on the website are as follows:
A WordPress plugin designed to integrate and synchronize WooCommerce activities with Pipedrive. This service includes advanced customization and automation features to optimize commercial data management.
The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity, are presented on the website woocommerce-to-pipedrive.com, which the Client must read before placing an order.
The choice and purchase of a Product are the sole responsibility of the Client. Product offers are valid within the limits of available stock as specified at the time of placing the order.
These GTC are accessible at any time on the website woocommerce-to-pipedrive.com and shall prevail over any other document. The Client declares to have read these GTC and accepted them by ticking the box provided for this purpose before implementing the online ordering procedure on the website woocommerce-to-pipedrive.com.
Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Client.

The Products presented on the website woocommerce-to-pipedrive.com are offered for sale worldwide.
For orders placed to a country other than mainland France, the Client is considered the importer of the Product(s) concerned. For all Products shipped outside the European Union and French Overseas Territories (DOM-TOM), prices will be calculated exclusive of tax on the invoice. Customs duties or other local taxes, import duties, or state taxes may be payable. These will be the sole responsibility of the Client.
ARTICLE 2 - Pricing
The Products are provided at the rates in effect listed on the website woocommerce-to-pipedrive.com at the time the order is recorded by the Seller.
Prices are expressed in Euros, excluding taxes (HT) and including taxes (TTC).
The rates take into account any discounts granted by the Seller on the website woocommerce-to-pipedrive.com.
These rates are fixed and non-revisable during their validity period, but the Seller reserves the right to modify prices at any time outside this period.
Prices do not include processing, shipping, transport, and delivery costs, which are invoiced in addition under the conditions indicated on the website and calculated prior to the order being placed.
The payment requested from the Client corresponds to the total purchase amount, including these costs.
An invoice is issued by the Seller and delivered to the Client upon the availability of the Products via download.
ARTICLE 3 - Orders
It is the Client"s responsibility to select on the website woocommerce-to-pipedrive.com the Products they wish to order, according to the following process:
The Client selects a subscription plan and is redirected to the Stripe platform for payment of the chosen plan. Once the payment is validated, they are invited to create their account.
Product offers are valid as long as they are visible on the website, subject to stock availability.
The sale will only be considered valid after full payment of the price. It is the Client"s responsibility to verify the accuracy of the order and to immediately report any errors.
Any order placed on the website woocommerce-to-pipedrive.com constitutes the formation of a remote contract between the Client and the Seller.
The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute concerning the payment of a previous order.
The Client can track the progress of their order on the website.
Any cancellation of the order by the Client after its acceptance by the Seller will only be possible within 2 days of acceptance of the order by the Seller and as long as the download availability has not occurred (regardless of the provisions related to the legal right of withdrawal).
ARTICLE 3 Bis - Client Area - Account
To place an order, the Client is invited to create an account (personal area).
To do so, they must register by completing the form provided during their order and agree to provide truthful and accurate information about their identity and contact details, including their email address.
The Client is responsible for updating the information provided. They are informed that they can modify this information by logging into their account.
To access their personal area and order history, the Client must log in using their username and password, which will be communicated to them after registration and are strictly personal. In this regard, the Client is prohibited from disclosing them. Otherwise, they will remain solely responsible for their use.
The Client may also request account deletion by going to the dedicated page on their personal area or by sending an email to: contact@woocommerce2pipedrive.com. This will take effect within a reasonable time.
In case of non-compliance with the general terms and conditions of sale and/or use, the website woocommerce-to-pipedrive.com reserves the right to suspend or close the account of a Client after prior notice sent electronically and left without effect.
Deletion of an account, for any reason, results in the permanent deletion of all the Client"s personal information.
Any event due to a case of force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in case of maintenance does not engage the Seller"s responsibility.
The creation of the account entails acceptance of these general terms and conditions of sale.
ARTICLE 4 - Payment Terms
The price is paid through a secure payment method, as follows:
• Payment by credit card
The price is payable in full by the Client on the day the order is placed.
Payment data is encrypted using the protocol defined by the authorized payment service provider handling the banking transactions on the website woocommerce-to-pipedrive.com.
Payments made by the Client will only be considered final after the Seller has received the amounts due.
The Seller is not obligated to provide the Products ordered by the Client if the Client has not paid the full price under the conditions outlined above.
ARTICLE 5 - Availability of Digital Products
The Products ordered by the Client are digital products. Therefore, no physical delivery is involved.
The download availability occurs immediately after payment validation, to the email address provided by the Client when placing the order. A download link or access information will be sent to the Client to activate the purchased Product.
The Seller commits to making the Product available as soon as possible following order confirmation. In case of a delay exceeding 5 days due to reasons unrelated to force majeure or the Client"s fault, the Client may request order cancellation in accordance with articles L 216-2, L 216-3, and L241-4 of the French Consumer Code. The amounts paid by the Client will then be refunded in full within a maximum of fourteen days following receipt of the request.
The Client must verify the Product"s functionality upon availability. Any claims related to access issues or usability must be reported via email within one day of receiving access information, along with the necessary supporting documents.
The Seller will replace or rectify any defective or inaccessible Product at no additional cost to the Client, in compliance with legal provisions.
ARTICLE 6 - Transfer of Ownership
The transfer of ownership of the Products from the Seller to the Client will occur upon acceptance of the order by the Seller, signifying the agreement between the parties on the item and its price, regardless of the payment or delivery date.
ARTICLE 7 - Right of Withdrawal
Given the nature of the Products sold, the Client"s orders do not benefit from a right of withdrawal.
The contract is therefore definitively concluded once the order is placed by the Client under the conditions specified in these GTC.
ARTICLE 8 - Seller"s Liability - Warranties
The Products provided by the Seller come with:
• The legal warranty of conformity for defective, damaged, or incorrect Products that do not match the order,
• The legal warranty against hidden defects caused by a material, design, or manufacturing flaw affecting the delivered Products, rendering them unfit for use.
Legal warranty provisions:
Article L217-4 of the French Consumer Code
"The seller is required to deliver goods that comply with the contract and is responsible for any conformity defects existing at the time of delivery. The seller is also responsible for defects resulting from packaging, assembly instructions, or installation when such has been agreed upon in the contract or carried out under their responsibility."
Article L217-5 of the French Consumer Code
"The goods conform to the contract if:
1° They are suitable for the usual expected use of similar goods and, if applicable:
- Correspond to the description provided by the seller and possess the qualities that the seller presented to the buyer as a sample or model;
- Present the qualities that a buyer can legitimately expect, considering public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
2° Or they have the characteristics defined by mutual agreement between the parties or are suitable for any special use sought by the buyer, communicated to the seller and accepted by them."
Article L217-12 of the French Consumer Code
"The action resulting from a conformity defect is time-barred two years from the delivery of the goods."
Article 1641 of the French Civil Code
"The seller is bound by the warranty due to hidden defects in the item sold that render it unfit for its intended use or diminish its usefulness to such an extent that the buyer would not have acquired it, or would have paid a lower price, had they been aware of the defects."
Article 1648, paragraph 1, of the French Civil Code
"The action resulting from redhibitory defects must be brought by the buyer within two years of discovering the defect."
Article L217-16 of the French Consumer Code
"When the buyer asks the seller, during the course of the commercial warranty granted at the time of the acquisition or repair of a movable good, for a repair covered by the warranty, any immobilization period of at least seven days shall be added to the remaining warranty period. This period starts from the buyer"s request for intervention or the provision of the goods for repair, whichever is later."
To exercise their rights, the Client must inform the Seller in writing (email or mail) of the non-conformity of the Products or the existence of hidden defects upon discovery.
The Seller will refund, replace, or repair Products or parts deemed non-compliant or defective under warranty.
Shipping costs will be reimbursed based on the invoiced rate, and return costs will be refunded upon presentation of receipts.
Refunds, replacements, or repairs of Products deemed non-compliant or defective will be carried out as soon as possible and no later than 15 days following the Seller"s acknowledgment of the non-conformity or hidden defect. Refunds may be made by bank transfer or check.
The Seller"s liability shall not be engaged in the following cases:
• Non-compliance with the legislation of the country in which the products are delivered, which it is the Client"s responsibility to verify;
• Misuse, professional use, negligence, or lack of maintenance by the Client, as well as normal wear and tear, accidents, or force majeure.
• Photographs and graphics presented on the website are non-contractual and do not engage the Seller"s liability.
The Seller"s warranty is, in any case, limited to the replacement or refund of non-compliant or defective Products.
ARTICLE 9 - Personal Data
The Client is informed that the collection of their personal data is necessary for the sale and delivery of the Products entrusted to the Seller. This personal data is collected solely for the execution of the sales contract.
9.1 Collection of Personal Data
The personal data collected on the website woocommerce-to-pipedrive.com includes:
Account Creation
During the creation of the Client/User account:
Names, first names, postal address, phone number, and email address.
Payment
For payments related to Products offered on the website woocommerce-to-pipedrive.com, financial data related to the Client/User’s bank account or credit card is recorded.
9.2 Recipients of Personal Data
Personal data is used by the Seller and its subcontractors for contract execution and to ensure the effective delivery of the Products.
The category(ies) of subcontractor(s) include:

9.3 Data Controller
The data controller is the Seller, as defined under the French Data Protection Act and as of May 25, 2018, under Regulation 2016/679 on the protection of personal data.
9.4 Processing Limitation
Unless the Client provides express consent, their personal data is not used for advertising or marketing purposes.
9.5 Data Retention Period
The Seller will retain the data collected for a period of 5 years, covering the applicable contractual liability limitation period.
9.6 Security and Confidentiality
The Seller implements organizational, technical, software, and physical measures in digital security to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely secure environment, and the Seller cannot guarantee the security of data transmission or storage over the Internet.
9.7 Implementation of Client and User Rights
In accordance with applicable personal data regulations, Clients and Users of the website woocommerce-to-pipedrive.com have the following rights:
• They can update or delete their data by sending an email to contact@woocommerce2pipedrive.com for data deletion.
• They can delete their account by sending an email to the address provided in Article 9.3 "Data Controller."
• They can exercise their right of access to know the personal data concerning them by writing to the address provided in Article 9.3 "Data Controller."
• If the personal data held by the Seller is inaccurate, they can request that the information be updated by writing to the address provided in Article 9.3 "Data Controller."
• They can request the deletion of their personal data in accordance with applicable data protection laws by writing to the address provided in Article 9.3 "Data Controller."
• They can also request the portability of their data held by the Seller to another service provider.
• Finally, they can object to the processing of their data by the Seller.
These rights, provided they do not oppose the purpose of the processing, can be exercised by sending a request by mail or email to the Data Controller at the contact details provided above. The Data Controller must respond within a maximum of one month.
In the event of a refusal to fulfill the Client"s request, the reasons must be justified.
The Client is informed that in the event of refusal, they may lodge a complaint with the CNIL (3 Place de Fontenoy, 75007 PARIS) or seek judicial redress.
The Client may be invited to check a box indicating that they agree to receive informative and promotional emails from the Seller. They can withdraw their consent at any time by contacting the Seller (contact details above) or by clicking the unsubscribe link.
ARTICLE 10 - Intellectual Property
The content of the website woocommerce-to-pipedrive.com is the property of the Seller and its partners and is protected by French and international intellectual property laws.
Any total or partial reproduction of this content is strictly prohibited and may constitute a counterfeiting offense.
ARTICLE 11 - Governing Law - Language
These GTC and the operations arising from them are governed by and subject to French law.
These GTC are drafted in French. In the event that they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.
ARTICLE 12 - Disputes
For any complaints, please contact customer service at the Seller"s postal or email address indicated in ARTICLE 1 of these GTC.
The Client is informed that they may in any event resort to conventional mediation, sector-specific mediation bodies, or any alternative dispute resolution method (e.g., conciliation) in the event of a dispute.

All disputes arising from purchase and sale transactions concluded under these GTC and that have not been amicably resolved between the Seller or by mediation shall be submitted to the competent courts under ordinary law.
